More Name Issues for Cape-Arcona

In an earlier thread someone pointed out that Cape-Arcona had named a font "CA Stardust" not realizing that a T26 font bore the same name. It looks like a similar issue has cropped up. Cape-Arcona have a font called "CA Cosmo-Saturn/Pluto" and "a big Fonthouse" sent them a letter telling them that they had a font called Cosmos (possibly Berthold Cosmos?) and CA had to change theirs or pay a lot of money to fight it. Needless to say they bit the bullet and changed the font's name to "CA-Cosmolab."

In other news, CA has begun selling Eduardo Recife's beautiful "Nars" font on their site.

Do they have someone working for them searching for duplicate fonts names or font names that match 30%?? Pathetic again. Now if it was names Cosmos, that's perhaps another story.. but who cares anyway.

Another useless comment
;)

The two names are different enough. I would have loved to see this go to court, the judge would probably fine the ""big fonthouse" for being petty and wasting his time.

Jim Richardson | Sep 13, 2003 12:06 PM

But of course the point is you need a lot of money to even get to court. The system is rigged.

It's getting really hard to name fonts. Almost every name you think up is taken and most of the time you don't find out until much later. If only there was an easy way to do a search, google helps only part of the time. It's always a good idea to search the major foundries first when you have a good name idea.

Jess Latham | Sep 13, 2003 09:00 PM

Clearly, putting the initials of your foundry before the font name does not stave off the corporate bullying.

> It's getting really hard to name fonts.

You really think so? I've always thought that there are entire categories of names that have yet to be tapped. I have dozens of names in my notebooks, waiting for fonts to latch on to...

BTW

The best strategy is to make new words.
The term "Portmanteau" describes one way, which is to throw words together (as if into a suitcase).
Hrant is right about the categories.
But also, numbers and codes could be considered.
"AAAZ-270" would top most font lists!

One font name that comes to mind as wonderfully chosen is Parkinson's Azuza: it starts with an "A", it sounds nice, it's kind of memorable due to a town of that name, except the town is spelled "Azusa", which means that the Azuza font still comes up near the top (2nd) in Google. Plus it sort of tips its hat to the famous Tarzana (another SoCal town). And it's palindromic. That's the way to name your fonts.

Any name will do, as long as it won't potentially confuse fontwise

David | Sep 14, 2003 05:30 PM

Itīs ridiculous: The unnamed comapany (i may not say the name, itīs all confidental) has written to me tomorrow. They say that Cosmolab is too similar to Cosmos. I may not use any name in which the letters Cosmo appear. Iīm now thinking about a new name. Any good ideas?

Cape Arcona Stefan Claudius | Sep 15, 2003 12:58 AM

Astrolab?

John Nolan | Sep 15, 2003 03:25 AM

How about Kausmo? It sounds the same (at least in English) but doesn't have the C-O-S combination that lawyers seem not to like.

Sorry to hear about your annoyances with the big foundry, Stefan.

John Baichtal | Sep 15, 2003 04:23 AM

Stefan, how about Kosmo or Kosmos (the swedish name for the cosmos)?

Peter bruhn | Sep 16, 2003 12:20 AM

Use Somaco, or something like that.

Anyway, I'm pissed. I just found a free font with the same name I've been labeling some sketches with. The worst part is that it's a straight ripoff of a commerical font.

Colin | Sep 16, 2003 12:33 AM

Burphold Colosmo

Ann Onymous | Sep 16, 2003 03:22 AM

Colin, I wouldn't sweat it. I have a font I call Addled, and some free font site has a font also called Addled that is a ripoff of Ad Lib. Needless to say, I feel no pressing motivation to change the name of my font.

John Baichtal | Sep 16, 2003 03:58 AM

I'd name it something simular to Apple's first ever system sound: "Sosumi" (so sue me).

2003 is the year of the Rat, despite what the chinese zodiac might tell you. Laywer Rats. It's the year of the font naming threat, the tech lawsuit and the patent dispute-- and it's slowing down an industry that needs some damn accelleration.

I read this on "typophile.com":
From Anonymous:
"I visited Cape-Arcona.com today and saw on their first page, that Cape Arcona took down their font CA COSMOLAB.
Folks, you know they had problems with Berthold because CA renamed his CA COSMO who was to similiar to Bertholds font COSMO.
And after that, Bethold claimed, that the announcement that they renamed the font is not legal and that they must rename CA COSMOLAB to some other name WITHOUT mention that to CA customes. It's insane!
Haha, on a sidenote, they say "thank you" to the "unnamed type foundry" that they made Cape Arcona famous for that."

Here's the official CA press release:

Brothers and Sisters,
Foes & Dissidents
of Cape-Arcona

Announcement
-----------------------
With this day, Cape Arcona will not sell one of their famous fonts with the name CA Cosmolab-Saturn and CA Cosmolab-Pluto anymore.

Cape Arcona Type Foundry was advised to conceal the backgrounds of this action by an USA based "unnamed type foundry". We will not answer questions to that case, since it was forbidden by our own investigation department: C.A.S.I. - Cape Arconas Bureau of Secret Investigation.

Cape Arcona Type Foundry want to thank you "unnamed type foundry" for your actions who made us more popular then ever and become the "good guys"in the world of font foundries. Thank you!

C.A.D.I.A. - Cape Arcona Department of Illegal Affairs
The Director

Somebody start a boycott campaign, please!

Hrant | Sep 18, 2003 07:57 AM

With Berthold picking on Thirst, Zang-O and now Cape-Arcona, does anyone want to organize a Boycott Berthold campaign or a BertholdSux font competition?

Nonny O'Mouse | Sep 18, 2003 11:11 AM

Hahaha, i got a newsletter from Cape-Arcona (info also on their site). They released their old CA Cosmolab under a new name. it's called "CA Case150903".
I think, this is the date of which Berthold mailed them?

Anyway, they also offer a new freefont and a font catalog.
The funny thing is, that the content of their font catalog is full with correspondece between Cape and hmm, I think Berthold. It's all crossed out, so that nobody knows which "large type foundry" they realy speak about.
Hahaha, this guys are really funny! :)

Here is the official press release:

Slightly stale link: Luc Devroye is covering this story pretty well.

John Baichtal | Sep 19, 2003 08:15 AM

It is good to see Luc Devroye has collected all of that information in to one place. It makes me wonder a couple of things though.

What kind of legal leg do Berthold have to stand on? Can they only go after poeple who "infringe" who are based in Germany or USA?

My feeling would be that any case they got together would fall apart pretty fast in a courtroom.

David | Sep 20, 2003 02:42 AM

Wow! I'm delighted with "Burphold Colosmo" from Ann Onymous. I like this name. I love You, "Ann"!

Another proposition: "Old Berth Mo Cos by H. & M. Hurt".

And who can help me to rename my fonts? My story is published on http://fontcity.ru/ev.htm. Messieurs Hunts requested me to change not only fonts names, but foundry and web-site names as well.

Type fraternity! Typeface designers and font names contrivers! Let's fight! Do not surrender! Boycott Berthold!

Thank You. Igor B. Shipovsky.

Igor B. Shipovsky | Nov 16, 2003 11:55 PM

The skank's letter was interesting... it's obvious from the letter that she can't sue Mr. Shipovsky -- she's suing MyFonts. Which is absurd. The worst that could happen would be that MyFonts would refuse to carry FontCity's stuff anymore. Big whoop. Don't cave in, Igor! You can always sell via PayPal or something.

Billy Bob Berthold | Nov 17, 2003 04:09 AM

Dear Sirs, dear Billy,

Please, visit http://typophile.com/forums/massages/30/16157.html
There are many interesting offers and other information there.
Remember: I love You all. The only thing I want is to work and create new fonts.

Thank You. Yours respectfully, Igor.
